These Terms and Conditions ("Terms") govern your use of www.javieraxestrada.com (the "Site") and any purchases made through the Site. By accessing the Site or placing an order, you agree to be bound by these Terms.
1. General Information
The Site is owned and operated by Javiera Estrada, based in Los Angeles, California. All artworks, designs, images, and text on the Site are the intellectual property of Javiera Estrada and may not be reproduced or redistributed without written permission.
2. Product Descriptions
I strive to describe all products and artworks as accurately as possible. In regards to custom pieces, because of my hand-painted, hand-dyed, or custom processes, slight variations in color, texture, or finish may occur. These variations are considered part of the unique nature and value of each piece.
3. Orders, Payment & Pricing
I accept all major credit cards and secure online payments.
All prices are listed in USD.
Sales tax is applied based on the shipping address and applicable state law.
Orders are processed only after payment is received in full.
4. Shipping & Delivery
Shipping is available domestically and internationally.
Delivery timelines depend on whether an item is in stock, made-to-order, or a custom commission. Estimated delivery times will be provided at checkout and confirmed after purchase.
Once shipped, I am not responsible for carrier delays, damages, or lost packages.
5. Returns & Cancellations
Due to the nature of fine art, custom wearable art, and limited editions, all sales are final unless otherwise noted.
For California residents: see Section 6 regarding the cooling-off period for certain in-person sales.
6. California Cooling-Off Period (Fine Art Sales)
In compliance with California Civil Code §1689.6 – 1689.13, any door-to-door or off-premises sales of original fine art over $100 are subject to a three-business-day cooling-off period, during which the buyer may cancel the sale for a full refund.
This right does not apply to online or eCommerce transactions unless the sale is conducted in person outside of a gallery or studio (e.g., at a private residence, pop-up market, or temporary exhibition).
How to Cancel:
For eligible in-person purchases, you must email javiera@javieraestrada.com within 3 business days of purchase. Include your order number, full name, and the reason for cancellation. A refund will be processed once the item is returned in original condition.
7. Custom Commissions
Custom and commissioned works are final sale.
For high-value commissions, a written agreement may be required outlining timelines, payments, and approvals.
I work closely with clients during the process to ensure satisfaction.
8. Intellectual Property
All content on the Site — including but not limited to artworks, images, photographs, designs, logos, and text — is the intellectual property of Javiera Estrada or its licensors. Content may not be copied, reproduced, or distributed without written consent.
9. Privacy Policy
Personal data collected through this Site will be handled in accordance with my Privacy Policy.
10. Dispute Resolution
These Terms are governed by the laws of the State of California. Any dispute arising under these Terms will be resolved exclusively in the courts located in Los Angeles County, California.
11. Changes to Terms
I reserve the right to update or modify these Terms at any time. Continued use of the Site after such changes constitutes your acceptance of the updated Terms.
